Pensions – Automatic Enrolment

In 2018 employers were fined over £60m by The Pensions Regulator

Employers are still being fined for non-compliance and listed for public viewing on The Pension Regulator's website. Click below for a list of historic penalty notices issued by The Pensions Regulator where individual penalties have amounted up to £52,500.

Are you compliant?

There is more to just having a qualifying pension scheme in place to ensure you comply with the rules. VT Payroll assists clients with the following employer duties including:

​

  • Preparation of statutory communications to be issued to employees

  • Monitoring pension contribution levels to ensure at least the minimum is being applied.

  • Frequently assessing your workforce, identifying whether staff trigger your obligation to enroll them into the pension scheme (following postponement, age, salary spike, place of work)

  • Submission of declaration and re-declaration of compliance by the deadline

Re-enrolment & Re-declaration

Most employers are approaching or have already reached their three-year anniversary for automatic enrolment. Every three years you must put certain staff who have left your pension scheme back into it.

Whether you have staff to put back into your scheme or not, you must complete a re-declaration of compliance to tell The Pensions Regulator you have complied with your duties.

What if I don’t have any staff?

Automatic enrolment duties don’t apply when an organisation, business or individual are not considered an employer.

​

You are still an employer if you employ someone who doesn’t meet the criteria to be put into a pension scheme.

​

You won’t have any duties if you meet one of the following criteria:

​

  • you’re a sole director of an organisation or business with no other staff

  • your organisation or business has a number of directors, none of whom has an employment contract, with no other staff

  • your organisation or business has a number of directors, only one of whom has an employment contract, with no other staff

  • your organisation or business has gone into liquidation. This option is for companies registered on Companies House

  • your organisation or business has been dissolved. This option is for companies registered on Companies House

  • you’re a partnership or limited liability partnership and you have permanently ceased trading

  • you’re a sole trader and you have permanently ceased trading

  • you’re an individual and you no longer employ someone in your home (a cleaner, nanny, personal care assistant etc)
